Agreement to Terms
By engaging The Yard Doctor (“Company,” “we,” “our,” or “us”) for pest control and landscape care services, you (“Customer,” “you,” or “your”) agree to be bound by these Terms and Conditions. Please read these terms carefully before using our services.
Services Provided
Pest Control Services
- Exterior Pest Management: Treatment for ants, spiders, roaches, ticks, mosquitoes, gophers, squirrels, and other specified pests
- Monthly Service Programs: Regular scheduled treatments with immediate response available
- Inspection Services: Property assessment and treatment recommendations
Landscape Care Services
- Plant Health Care: Fertilization, disease control, insect management
- Tree Health & Maintenance: Disease treatment, fertilization, de-fruiting services
- Soil Treatment: Compaction remediation, soil amendments
- Lawn Care: Fertilization, weed control, over-seeding
- Landscape Renovation: Pruning, restoration services

Services are provided in Fresno, Madera, and Merced Counties, California.
Service Terms and Conditions
Scheduling and Access
- Property Access: Customer must provide reasonable access to treatment areas
- Scheduling: Services scheduled during normal business hours unless otherwise arranged
- Weather Conditions: Services may be postponed due to adverse weather conditions
- Notification: Customer will receive advance notice of scheduled service visits
Treatment Procedures
- Professional Application: All treatments performed by licensed, trained technicians
- Pet Safety: Pet-friendly products used; pets should be secured during treatment
- Product Selection: Company reserves right to select appropriate products for specific conditions
- Re-treatment: Additional treatments may be necessary based on pest pressure or environmental conditions
Payment Terms
Pricing and Billing
- Service Fees: As quoted in service agreement or current rate schedule
- Billing Cycle: Monthly, quarterly, or annual billing as specified in service agreement
- Payment Due: Payment due within 30 days of invoice date
- Late Fees: Late charges may apply to overdue accounts
Payment Methods
- Accepted Methods: Cash, check, credit cards, and electronic payments
- Automatic Payment: Available for recurring service plans
- Payment Processing: Third-party payment processors may be used
Service Guarantees and Warranties
Pest Control Guarantee
- Service Guarantee: If pest problems persist between scheduled services, we will return at no additional charge
- Guarantee Period: Guarantee applies between regularly scheduled services
- Customer Cooperation: Guarantee requires customer compliance with preparation instructions
Landscape Care Results
- Growing Conditions: Results depend on weather, soil conditions, and environmental factors beyond our control
- Plant Health: We guarantee proper application of treatments, not plant survival
- Seasonal Variations: Results may vary by season and environmental conditions
Limitation of Warranties
- Express Warranties Only: No implied warranties beyond those expressly stated
- Third-Party Products: Manufacturer warranties apply to products used
- Environmental Factors: No warranty for damage caused by weather, disease, or other uncontrollable factors
Cancellation and Termination
Customer Cancellation
- Notice Required: 30 days written notice required for service cancellation
- Refund Policy: Prepaid services will be refunded on a pro-rata basis
- Final Treatment: Customer responsible for payment of services rendered through cancellation date
Company Termination
- Right to Terminate: We reserve the right to terminate services for non-payment or breach of terms
- Notice: Reasonable notice will be provided when possible
- Outstanding Balances: All outstanding balances become immediately due upon termination
Liability and Insurance
Limitation of Liability
- Service Liability: Our liability is limited to the cost of services provided
- Consequential Damages: We are not liable for indirect, incidental, or consequential damages
- Property Damage: Liability for property damage limited to direct, proven damages caused by our negligence
Insurance Coverage

Customer Responsibilities
- Property Preparation: Customer responsible for preparing treatment areas as instructed
- Disclosure: Customer must disclose relevant property conditions, allergies, or sensitivities
- Compliance: Customer must comply with post-treatment instructions
Intellectual Property
Company Materials
- Proprietary Information: Treatment programs, formulations, and procedures are proprietary
- Customer Lists: Customer information is confidential and proprietary
- Marketing Materials: All marketing materials remain property of The Yard Doctor
Customer Information
- Treatment Records: We maintain records of services provided for regulatory compliance
- Photo Documentation: Before/after photos may be taken with customer consent for service documentation
Regulatory Compliance
Licensing and Permits
- State Licensing: All pest control work performed under appropriate state licenses
- Local Permits: Compliance with all local regulatory requirements
- Continuing Education: Technicians maintain required continuing education and certifications
Environmental Compliance
- EPA Regulations: All products used in compliance with EPA regulations
- Application Standards: Treatments performed according to manufacturer specifications
- Record Keeping: Detailed records maintained as required by regulatory agencies
Dispute Resolution
Informal Resolution
- Direct Communication: Disputes should first be addressed through direct communication
- Management Review: Unresolved issues will be reviewed by company management
- Good Faith Efforts: Both parties commit to good faith efforts to resolve disputes
Formal Resolution
- Applicable Law: These terms governed by California state law
- Jurisdiction: Disputes subject to jurisdiction of California courts
- Severability: If any provision is unenforceable, remaining terms remain in effect
Indemnification
Customer agrees to indemnify and hold harmless The Yard Doctor from claims arising from:
- Customer’s failure to follow preparation or post-treatment instructions
- Undisclosed property conditions or sensitivities
- Third-party claims related to customer’s property or activities
Changes to Terms
Modification Rights
- Updates: We reserve the right to modify these terms with reasonable notice
- Notification: Changes will be communicated via email, mail, or website posting
- Continued Service: Continued use of services constitutes acceptance of modified terms
